"Cemetery Keepers File Suit over road" Ashland Daily Independent June 5, 2004. "The keepers of a family cemetery on Ky. 5 have filed suit against a dentist and property developer for allegedly using the access road to the cemetery without permission...the suit...accuses...of using the road to the ...cemetery for their own purposes and convenience, even though they knew the road was private property. The matter surfaced after...built a house ...on land adjacent to the cemetery...the only access to...[the] house...was via the cemetery road...the deeds for the land were entered on Jan 8 and May 15 of last year...the suit alleges that the defendants caused water lines and other lines to be installed across the plaintiffs property ...On April 29 the defendants were given written notice to cease using the roadway and to restore the road to its original condition, including reinstallation of a gate that had been removed...the next month...heirs replaced the posts and gate across the entrance...after defendants failed to do so...suit alleges that...destroyed the chains anchoring the gate, cut the posts and threw the gate over a hillside....plaintiffs...purchased yet another gate along with new posts...Judge C. David Hagerman issued a temporary restraining order forbidding defendants from trespassing on plaintiffs property. Claims made in a lawsuit state only one side of a case."
